ENZACTA's Terms and Conditions follow the standard terms and conditions of e-commerce announced by the Fair Trade Commission.
Article 1 (Purpose)
The purpose of this Agreement is to prescribe the rights, obligations, and responsibilities of Cyber Mall and users in using Internet-related services (hereinafter referred to as "services") provided by Enzacta Cyber Mall operated by Enzacta Co., Ltd. 「"These terms and conditions shall apply mutatis mutandis to e-commerce using PC communication, wireless, etc. unless it is contrary to its nature."Article 2 (Definitions)
① The term "mall" means a virtual business place where a company can trade goods, etc. using information and communication facilities such as computers to provide goods or services (hereinafter referred to as "goods, etc.") to users, and is also used in the sense of a business operator operating a cyber mall.② The term "user" means a member or non-member who accesses the "mall" and receives the services provided by the "mall" in accordance with these terms and conditions.
③ The term "member" means a person who has registered as a member by providing personal information to the "mall", who is continuously provided with the information of the "mall" and can continuously use the services provided by the "mall".
④ The term "non-member" means a person who does not join a member and uses the services provided by the "mall".
Article 3 (Explanation, explanation, and revision of the terms and conditions)
① "Mall" will post the contents of these terms and conditions, the name of the representative, the address of the business office (including the address of the place where consumers can handle their complaints), the phone number, the business registration number, the mail order number, and the personal information management manager on the initial service screen (front) of Enzacta Cyber Mall. However, the contents of the terms and conditions can be viewed by the user through the connection screen.② "Before the user agrees to the terms and conditions, the mall must provide a separate connection screen or pop-up screen to help the user understand important contents such as subscription withdrawal/delivery liability/refund conditions.
③ "Mall" may amend the terms and conditions to the extent that it does not violate the relevant laws, such as the Consumer Protection Act in e-commerce, the Framework Act on Electronic Transactions, the Electronic Signature Act, the Information and Communication Network Utilization Promotion Act, the Door-to-door Sales Act, and the Consumer Protection Act.
④ If "Mall" revises the terms and conditions, it shall be notified on the initial screen of the mall with the current terms and conditions from 7 days before the application date to the day before the application date. However, if you change the terms and conditions against the user, you will be notified with a grace period of at least 30 days in advance. In this case, the "mall" clearly compares the contents before and after the revision and marks them for easy user understanding.
⑤ If "Mall" amends the terms and conditions, the revised terms and conditions apply only to contracts concluded after the application date, and the terms and conditions before the amendment apply to contracts already concluded before that. However, if a user who has already signed a contract sends his/her intention to be subject to the revised terms and conditions to "mall" within the notice period of the revised terms and conditions under paragraph (3), the revised terms and conditions apply.
⑥ Regarding matters not stipulated in the terms and conditions and interpretations of these terms and conditions, the Consumer Protection Act in e-commerce, the Regulation of Terms, etc. and the Consumer Protection Guidelines in e-commerce prescribed by the Fair Trade Commission, etc. shall be followed.
Article 4 (Provision and modification of services)
① "Mall" performs the following tasks:
1. Providing information on goods or services and concluding a purchase contract.2. Delivery of goods or services with a purchase contract signed.
3. Other duties prescribed by "mall".
② "Mall" may change the contents of the goods or services to be provided by a contract concluded in the future in the event of a shortage of goods or services or a change in technical specifications. In such cases, the contents of the changed goods or services and the date of delivery are specified and the contents of the current goods or services are immediately notified to the place where they are posted.
③ If the contents of a service contracted with the user to be provided by the "Mall" are changed due to a reason such as out of stock of goods or a change in technical specifications, the reason shall be notified to the user immediately. .
④ In the case of the preceding paragraph, "Mall" compensates for the damage suffered by the user. However, this is not the case if "mall" proves that there is no intention or negligence.
Article 5 (Interruption of Service)
① The "mall" may temporarily suspend the provision of services in the event of maintenance inspection, replacement, failure, or loss of communication of information and communication facilities such as computers.
② The "mall" shall compensate for damages suffered by the user or a third party due to the temporary suspension of the provision of services due to the reasons referred to in paragraph (1). However, this is not the case if "mole" proves that there is no intention or negligence.
③ If the service cannot be provided due to the change of business items, abandonment of business, or integration between companies, "Mall" notifies the user by the method prescribed in Article 8 and compensates the consumer according to the conditions originally set out in "Mall". However, if the "mall" does not notify the compensation standard, the user's mileage or reserves will be paid to the user in kind or cash corresponding to the currency value used in the "mall".
Article 6 (Membership)
① The user applies for membership by filling out the membership information according to the subscription form set by the "Mall" and expressing his/her intention to agree to the terms and conditions.
② The "mall" shall be registered as a member from among the users who have applied for membership as in paragraph (1) unless falling under any of the following subparagraphs:
1. Exceptions shall be made if the applicant for membership has previously lost his/her membership, but if he/she has obtained consent to rejoin the "mall" as a person who has passed one year since his/her membership was lost.
2. If there is a false, omission of entry, or mistake in the contents of the registration.
3. Where it is deemed that registration as a member is significantly hindered by the technology of "mall".
③ The time when the membership contract is established is the time when the consent of the "mall" reaches the member.
④ If there is a change in the registered matters under Article 15 (1), the member shall immediately notify the "mall" of the change by e-mail or other means.
Article 7 (Loss of membership, etc.)
① If a member falls under any of the following reasons, the "mall" may restrict and suspend his/her membership.
1. Where false information is registered at the time of application for membership.
2. 2. Payment for goods, etc. purchased using "mall", other "mall"Where the obligation borne by the member in connection with the use is not paid on the due date.
3. In the case of threatening the order of e-commerce, such as interfering with other people's use of "mall" or stealing such information.
②After the "mall" restricts or suspends its membership, if the same act is repeated more than twice or the reason is not corrected, the "mall" may lose its membership.
Article 8 (Notice to Members)
① If "Mall" notifies the member, it may be at the e-mail address designated by the member in advance with "Mall".
② "Mall" may be substituted for individual notices by posting them on the "Mall" bulletin board for at least one week in case of notification to an unspecified number of members. However, individual notifications are made regarding matters that have a significant impact on the member's own transaction.
Article 9 (Application for Purchase)
The user of "Mall" shall apply for purchase on "Mall" in the following or similar manner, and "Mall" shall provide each of the following information in an easy-to-understand manner when the user applies for purchase: However, if you are a member, the application of subparagraphs 2 through 4 may be excluded.1. Search and select goods, etc .
2. Enter your name, address, phone number, e-mail address (or mobile phone number), etc .
3. Check the details of the terms and conditions, services with limited subscription withdrawal rights, and the cost of shipping/installation.
4. Indication of agreeing to these terms and conditions and confirming or rejecting the matters in subparagraph 3 above.
5. Application for purchase of goods, etc. and consent to confirmation or confirmation of "mall".
6. Selection of payment method.
Article 10 (Establishment of a Contract)
① "Mall" may not accept an application for purchase as in Article 9 if it falls under any of the following subparagraphs.
1. Where there is a false, omission of entry, or mistake in the contents of the application.2. In the case where it is deemed that consenting to the purchase application is significantly hindered by the "mall" technology.
② The contract shall be deemed to have been concluded when the consent of the "mall" reaches the user in the form of a receipt confirmation notice under Article 12 (1).
③ The expression of intention to accept the "mall" shall include information on the confirmation of the user's purchase application, the availability of sale, cancellation of correction of the purchase application, etc.
Article 11 (Method of Payment)
The payment method for goods or services purchased at the "Mall" may be made by any of the following methods available: However, "mall" cannot be collected by adding any nominal fee to the payment of goods, etc. for the user's payment method.1. Transfer of various accounts such as phone banking, Internet banking, and mail banking.
2. Payment of various cards such as prepaid card, debit card, credit card, etc.
3. Online bank transfer.
4. Payment by electronic money.
5. Payment upon receipt.
6. Payment by points paid by "mall", such as mileage.
7. Payment by gift certificate entered into a contract with "Mall" or recognized by "Mall".
8. Payment by other electronic payment methods, etc.
Article 12 (Notification of receipt and change and cancellation of purchase application)
① "Mall" notifies the user of the receipt of the purchase request.
② If there is a discrepancy in the declaration of intention, the user can request the change or cancellation of the purchase application immediately after receiving the notification, and if the user requests it before delivery, the "mall" shall be processed according to the request without delay. However, if the payment has already been made, it shall be in accordance with the provisions of Article 15 on withdrawal of subscription.
Article 13 (Supply of Goods, etc.)
① "Mall" takes other necessary measures such as custom-made, packaging, etc. so that the user can deliver the goods within seven days from the date of subscription, unless there is a separate agreement with the user regarding the supply period of the goods. However, if the "mall" has already received all or part of the payment for goods, etc., it will take action within two business days from the date of receiving all or part of the payment.
② "Mall" specifies the delivery method, the person responsible for the delivery cost by means, and the delivery period by means for the goods purchased by the user. If "Mall" exceeds the agreed delivery period, the user shall be compensated for the damage caused by it. However, this is not the case if "mall" proves that there is no intention or negligence.
Article 14 (Refund)
"Mall" shall notify the user of the reason without delay if the goods, etc. requested by the user cannot be delivered or provided due to sold-out reasons, and shall refund or take necessary measures within two business days from the date of receipt of goods, etc.Article 15 (Withdrawal of subscription, etc.)
① Users who have entered into a contract with "Mall" regarding the purchase of goods, etc. may withdraw their subscription within seven days from the date of receipt confirmation.
② Users cannot return or exchange goods or other goods when they are delivered goods, etc. in the following cases:
1. Where goods, etc. are lost or damaged due to a responsible reason to the user (However, if packaging, etc. is damaged to confirm the contents of the goods, etc., the subscription may be withdrawn)2. In the case where the value of goods, etc. has significantly decreased due to the user's use or partial consumption.
3. Where the value of goods, etc. has decreased significantly to the extent that it is difficult to resell over time.
4. In the case where it is possible to reproduce goods with the same performance, etc., the packaging of the original goods, etc. is damaged.
③ The expression of intention to accept the "mall" shall include information on the confirmation of the user's purchase application, the availability of sale, cancellation of correction of the purchase application, etc.
④ Notwithstanding the provisions of paragraphs (1) and (2), if the contents of goods, etc. are different from the contents of the advertisement or the contents of the contract, the user may withdraw the subscription within three months from the date of receiving the goods, or within 30 days from the date of knowing or knowing the fact.
Article 16 (Effect of withdrawal of subscription, etc.)
① "Mall" shall refund the amount of goods, etc. already paid within three business days when the goods, etc. are returned from the user. In such cases, if the "mall" delays the refund of goods, etc. to the user, the delayed interest calculated by multiplying the delayed interest rate determined and announced by the Fair Trade Commission shall be paid for the delay period.
② In the refund of the above payment, "Mall" requests the business operator who provided the payment method to stop or cancel the payment for the goods, etc. without delay when the user pays for the goods by a payment method such as credit card or electronic currency.
③ In the case of withdrawal of subscription, the user shall bear the expenses necessary for the return of the supplied goods, etc. "Mall" does not claim penalty or compensation for damages due to withdrawal of subscription. However, if the contents of goods, etc. are different from the contents of the display and advertisement or the contents of the contract are implemented differently and the subscription is withdrawn, the cost necessary for the return of goods, etc. shall be borne by the "mall".
④ When a user pays the shipping cost when receiving goods, etc., the "mall" clearly indicates who pays the cost when withdrawing the subscription so that the user can easily understand.
Article 17 (Protection of Personal Information)
① "Mall" collects the minimum information necessary to fulfill the purchase contract when collecting user information. The following are mandatory and the others are optional.
1. Name.2. Resident registration number (for members).
3. Address.
4. Phone number.
5. Password (for members).
6. E-mail address (or mobile phone number)
② When "Mall" collects personal information that can be identified by the user, it must obtain the consent of the user.
③ The provided personal information cannot be used for any purpose other than the purpose or provided to a third party without the consent of the user, and all responsibility for this shall be disregarded. However, exceptions are made in the following cases:
1. In the case of informing the delivery company of the minimum user's information (name, address, phone number) necessary for delivery during delivery business.2. In the case of providing a specific individual in an unidentifiable form as necessary for statistical preparation, academic research, or market research.
3. Where it is necessary for settlement of payments due to transactions of goods, etc.
4. Where it is necessary for identification to prevent theft.
5. Where there is an inevitable reason necessary under the provisions of the Act or the Act;
④ Where "Mall" requires the user's consent under paragraphs (2) and (3), the person in charge of personal information management (name and phone number), the purpose of collection and use of information, the information provision to a third party, etc. shall be specified or notified in advance.
⑤ Users can request access to and correct errors in their personal information held by "Mall" at any time, and "Mall" is obligated to take necessary measures without delay. If a user requests correction of an error, "Mall" will not use the personal information until the error is corrected.
⑥ "Mall" shall minimize the number of managers to protect personal information, and shall be responsible for all damages caused by loss, theft, leakage, modification, etc. of users' personal information, including credit cards, bank accounts, etc.
⑦ When the purpose of collecting personal information or the purpose of receiving personal information is achieved, the relevant personal information shall be destroyed without delay.
Article 18 (Obligation of "Mall")
① The "mall" shall not engage in acts prohibited by laws and conditions or contrary to public order and shall do its best to provide goods and services continuously and stably as prescribed by these terms and conditions.
② "Mall" shall have a security system to protect users' personal information (including credit information) so that users can use Internet services safely.
③ The "mall" is responsible for compensating the user for damages by performing unfair display and advertisement acts prescribed in Article 3 of the Fairness of Labeling and Advertising Act on goods or services.
④ "Mall" does not send advertising e-mails for profit that you do not want.
Article 19 (Obligation to the ID and password of the member)
① Except for the case of Article 17, the member is responsible for managing the ID and password.
② Members should not allow third parties to use their IDs and passwords.
③ If a member recognizes that his/her ID and password have been stolen or used by a third party, he/she shall immediately notify the "mall" and follow the instructions of the "mall".
Article 20 (Obligations of Users)
The user shall not:1. Registration of false information upon application or change
2. Stealing other people's information.
3. Change of information posted on "Mall".
4. Transmission or posting of information (computer programs, etc.) other than the information prescribed by the "mall".
5. Infringement of intellectual property rights such as copyrights of "mall" or other third parties.
6. "Mall" or other acts that damage the reputation of a third party or interfere with business.
7. Disclosure or posting of obscene or violent messages, images, voices, or other information contrary to public morals on the mall.
